Terms of Service

These Terms of Service ("Terms") govern your use of the LVC Distro communications platform and the LVC IT Dashboard (collectively, "the Services"), operated by Lakeview Construction, LLC ("LVC," "we," "us"). By accessing or otherwise using the Services, you agree to these Terms.

1Eligibility and purpose

The Services are intended exclusively for current employees and contractor superintendents of Lakeview Construction, LLC, and for designated office staff and operations leadership. The Services are not a public-facing product. By using the Services, you confirm that you have a current employment or contractor relationship with LVC.

Usage activity. To understand how the Services are used, the Services log which pages, screens, buttons and links are used and how long pages are open. Typed content is never recorded. This information is for internal use by LVC, is not sold, and is not shared with third parties.

2Description of services

LVC Distro is an internal communications platform that delivers branded one-page communications across four channels:

• SuperSpeak — safety briefings, Tech Talks, and jobsite information for superintendents and sub-superintendents.
• LVC Memo — internal updates for office staff (HR, IT, insurance, accounting, operations).
• LVC All-Hands — company-wide announcements that reach every recipient.
• LVC Custom — ad-hoc internal sends with audience selected at compose time.

The LVC IT Dashboard is the administrative surface for managing the platform and viewing engagement data.

3Acceptable use

You agree to use the Services lawfully and in keeping with Lakeview Construction's standards of conduct. You agree not to:

• Forward, screenshot-and-share, or otherwise distribute LVC Distro link contents outside the company unless the message itself explicitly permits external sharing.
• Attempt to gain access to portions of the LVC IT Dashboard for which you have not been authorized.
• Submit photos or text responses that are unlawful, harassing, or unrelated to the question prompt.
• Attempt to spoof, intercept, or interfere with the underlying SMS, email, or web infrastructure.

4Communications channels and SMS consent

Lakeview Construction provides multiple communication channels for internal company purposes, including email, in-dashboard notifications, in-app push notifications, and SMS text messages.

If you are currently subscribed to LVC SMS notifications, you may revoke that consent at any time by replying with any of the following keywords to any LVC text message: STOP, UNSUBSCRIBE, CANCEL, END, or QUIT. Your opt-out is honored immediately upon receipt. You may also opt out at any time via our dedicated opt-out page. For help, reply HELP to any LVC text message or visit our help page.

SMS opt-out is channel-specific. Opting out of one channel (for example, SuperSpeak) does not opt you out of other channels (for example, LVC All-Hands). To opt out of all LVC SMS channels at once, use the opt-out page or contact the IT administrator in Section 10.

Other LVC communications channels — email, in-dashboard notifications, in-app push notifications — are governed by the rest of these Terms, by our Privacy Policy, and by your separate access and use of the LVC IT Dashboard and LakeviewApp mobile application. These channels are not governed by SMS-specific consent and have their own opt-out mechanisms inside the dashboard and mobile app preferences.

5Content ownership and license

All content distributed through LVC Distro — including text, attachments, banner artwork, and templated layouts — is the property of Lakeview Construction, LLC and is for internal use only. By submitting an answer or uploading a photo in response to a Distro prompt, you grant Lakeview Construction a perpetual, royalty-free license to use that submission for the purposes of internal operations, safety analysis, training material development, and program improvement.

6Privacy

Our handling of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms.

7Service availability

We make reasonable efforts to keep the Services available but do not warrant uninterrupted availability. The Services may be unavailable due to planned maintenance, infrastructure failure, third-party outages, or other events outside our control.

8Termination

Lakeview Construction may suspend or terminate your access to the Services at any time if your employment or contractor relationship with the company ends, or if you violate these Terms. Upon termination, your phone number will be removed from active distribution lists, though historical engagement data may be retained as described in the Privacy Policy.

9Limitation of liability

To the maximum extent permitted by law, Lakeview Construction's liability arising out of or related to the Services is limited to direct damages caused by gross negligence or willful misconduct. The Services are provided "as is" without warranties of any kind, express or implied.

10Governing law and contact

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Kenosha County, Wisconsin.

11Changes to these Terms

We may update these Terms from time to time. The "Effective date" and "Last updated" lines at the top reflect the most recent revision. Material changes will be communicated via the LVC IT Dashboard or, for active SMS subscribers, via an LVC Distro message.
