Privacy Policy
This Privacy Policy describes how Lakeview Construction, LLC ("LVC," "we," "us") collects, uses, and safeguards personal information through the LVC Distro communications platform, the LVC IT Dashboard, and the Lakeview mobile app for iPhone (iOS) and Android (the "LakeviewApp"; collectively, "the Services"). The Services are operated for the internal benefit of Lakeview Construction's employees, contractor superintendents, sub-superintendents, and office staff.
1Who we are
Lakeview Construction, LLC is a commercial construction company headquartered at 10505 Corporate Drive, Suite 200, Pleasant Prairie, WI 53158. Main phone: 262.857.3336. We have operated since 1993.
2Information we collect
2.1 Information collected during your hiring or contractor onboarding
As part of your employment or contractor relationship with Lakeview Construction, the company maintains a personnel record that includes your name, mobile and/or business phone number, email address, job title, and work location. This personnel record exists independently of the Services and is governed by your employment or contractor agreement and Lakeview Construction's HR data handling practices. The Services read certain fields from this record (such as your name, role, and email) to populate the dashboard's Office Directory and to route messages to the appropriate channels.
2.2 Information collected when you sign in to the dashboard or mobile app
There are two ways to sign in:
- Lakeview employees sign in with their @lvconstruction.com Microsoft 365 account.
- Subcontractor superintendents sign in through the Lakeview Partners sign-in (Microsoft Entra External ID), using a Google account or an email address and one-time code. We receive your name and email address from that sign-in; we never see your Google or email password.
When you sign in, we collect your sign-in identifiers (name and email), role assignments, device identifiers (for the mobile app), session timestamps, IP addresses, and user-agent strings. This information is used to enforce role-based access control, log access for security audit, route push notifications (mobile app), and present a live "who's-on-the-dashboard" view to administrators.
2.2a Information collected by the LakeviewApp (iOS and Android)
The app only asks for a phone permission when you use the feature that needs it, and you can turn any permission off in your phone's Settings. Turning one off only disables that feature.
- Camera — to take jobsite photos for daily reports and the Lakeview camera, and to scan printed sub lists into text.
- Precise location (only while the app is open) — each jobsite photo is stamped with the date and time, GPS coordinates, accuracy, altitude, compass heading and the street address, so the office can verify where and when it was taken. Location is also used for the "Local" feature (places near you or the job) and nearby-contact searches. The app never tracks your location in the background or when it is closed.
- Microphone and speech recognition — for voice dictation into daily report fields and for short job videos. Dictation audio is processed by your phone's built-in speech service (Apple on iPhone, your device's speech service, typically Google, on Android) and only the resulting text is used by the app. We do not store your audio.
- Photos — to save stamped photos to your phone's photo library (you can turn this off in the camera settings) and to let you choose existing photos to attach. The app does not browse or upload your library; it only receives the specific photos you pick.
- Contacts — only when you tap "Add to Contacts" on a person's card, to save that one contact to your phone. The app does not read or upload your address book.
- Notifications — daily report reminders, upload status, and company alerts. On iPhone we store a push token together with your device name, model, OS and app version, time zone, language and notification setting so alerts reach the right phone.
What you send us. When you file a daily report, the report contents (work performed, crew names, companies, trades and hours, deliveries, weather, incidents and notes), photos with their location/time stamp details and the device model and app version that took them, and any videos are uploaded to Lakeview's Azure storage and become part of that project's job record. If you use "Report an app problem," we receive your message, an optional screenshot you choose to attach, the screen you were on, the app version, device model and operating system version; these reports go to the Lakeview IT team.
Stored on your phone. Unsent report drafts, the upload queue, and stamped photos waiting to send are kept in the app's private storage on your phone until they are sent or discarded (drafts are cleared after 14 days on iPhone). Your sign-in session is kept on the phone so you stay signed in; signing out removes it.
2.3 Information collected when you opt in to SMS notifications
When you submit the SMS opt-in form, we collect and store the following in an audit log specifically for SMS consent compliance:
- The full name, mobile phone number (E.164 format), email address (if you provide one), and role (if you provide one) you submitted on the form
- The exact wording of the consent statement you agreed to (a snapshot taken at the time of submission)
- The IP address from which the form was submitted
- The browser and operating system you used (user-agent string)
- The timestamp of submission
- The URL of the opt-in page at the time of submission
- The action (initial opt-in, confirmation of opt-in via SMS reply, opt-out via SMS keyword, opt-out via opt-out page, or re-opt-in)
This audit log is used solely to demonstrate, if ever challenged, that you provided informed consent before we sent you SMS messages. It is required by carrier guidelines (CTIA Short Code Monitoring Handbook), the federal Telephone Consumer Protection Act (TCPA), and our toll-free messaging provider (Microsoft Azure Communication Services).
2.4 Information collected when you receive and interact with LVC messages
When an LVC Distro message is delivered to you and you tap the link, we log the timestamp of the click, the IP address from which the page was loaded, the approximate geographic location derived from that IP (city/state/country only — never a precise location), the device and browser used, and any answers or photo uploads you choose to submit in response to a question prompt in the message. We also log delivery status events reported by the SMS or email service provider (delivered, bounced, opt-out keyword received).
2.x Usage activity on the Services
To understand how our tools are used and to make them better, the LVC IT Dashboard and the LakeviewApp record which pages, screens, buttons and links are used, when, from which device type (web or mobile app), and how long pages are actively open. We do not record what you type into fields, and we do not record keystrokes or field contents. This information is used internally by LVC management to understand usage of the Services; it is not sold and not shared with third parties. Detailed activity records are kept for 90 days; summary daily totals (counts and time) are kept longer.
3How we use this information
- To deliver internal company communications (safety briefings, training content, jobsite information, policy updates, company announcements).
- To measure engagement with those communications so leadership can follow up with personnel who may need additional support.
- To improve the relevance, timing, and content of future communications.
- To respond to opt-out requests, technical support inquiries, or other recipient-initiated contacts.
- To maintain audit logs that demonstrate compliance with carrier guidelines and applicable telecommunications law.
- To enforce role-based access controls and detect unusual activity on the dashboard or mobile app.
We do not sell your information. We do not share your information with third parties for marketing purposes. We do not use your information for any purpose unrelated to your role at Lakeview Construction or to the operation of the Services.
4Who has access
Access to personally identifiable engagement data is limited to:
- Tony Bohn, IT Administrator — full system administrator.
- Designated Distro role-holders — currently Marc Delsman (Owner) and additional grants made on an as-needed basis. Distro Composers can send messages within their assigned channels. Distro Viewers can see engagement reporting for their assigned channels.
- Microsoft Azure, our hosting provider, holds data on our behalf in their U.S. data centers under their standard customer data protection terms.
- Microsoft Azure Communication Services, our toll-free SMS provider, processes the phone numbers and message contents necessary to deliver SMS messages, and may share aggregate, anonymized data with the toll-free messaging aggregator and carriers for verification and abuse-prevention purposes.
- ipinfo.io, our IP-to-city geolocation service, processes IP addresses to return city/state/country values used in engagement analytics. IP addresses are not stored by ipinfo.io longer than required to return the lookup.
- Microsoft Entra ID / Entra External ID handles sign-in for employees and for subcontractor superintendents (including Google sign-in for partners).
- Apple (iPhone) and Google (Android) provide the phone's push notifications, speech-to-text dictation, map and address lookups for the device's location, and app distribution (TestFlight / App Store and Google Play).
- Open-Meteo receives a job's approximate coordinates to return the day's weather for a report. No name or account information is sent.
- OpenFreeMap supplies map images for the Android app's maps. Map image requests reveal the area being viewed but no account information.
- YouTube serves preview images (and, where used, videos) for Lakeview University training content.
The LakeviewApp contains no advertising, no third-party analytics or crash-reporting tools, and we never sell or share app data for advertising.
5Retention
In short: Lakeview Construction keeps the information collected through the Services indefinitely (permanently), unless a shorter period is stated below for a specific item. Closing an account ends that person's access; it does not delete their data. See "Closing your app account" in Section 6.
Engagement event logs (sent, clicked, answered, photo-uploaded, opted-out) are retained indefinitely for compliance defense and historical reporting. The interface defaults to a 30-day view, but the underlying data persists. Photos uploaded via response prompts are retained for the lifetime of the associated campaign.
Daily reports, jobsite photos and videos submitted through the dashboard or LakeviewApp are business records of the project and are kept with that project's records. App problem reports are kept until the issue is resolved and reviewed. Sign-in and access logs are kept for security auditing.
SMS consent audit records (the SmsConsentLog described in Section 2.3) are retained for at least seven (7) years from the date of the consent action. This retention period is required to defend against potential challenges under the Telephone Consumer Protection Act (TCPA) and aligns with the longest statute of limitations applicable to SMS consent disputes in the United States.
Opt-out records are retained indefinitely as required by carrier regulations — once a phone number has opted out, the record of that opt-out is permanent so that the number is excluded from all future sends.
6Your rights and opt-out
You may opt out of LVC Distro text messages at any time by replying with any of the following keywords to any LVC text message: STOP, UNSUBSCRIBE, CANCEL, END, or QUIT. Your opt-out is honored immediately upon receipt. You will receive a single confirmation text acknowledging the opt-out.
You may also opt out (or opt in) at any time via these dedicated pages:
- SMS Opt-In Page — the only place to start a new subscription
- SMS Opt-Out Page — to opt out of a specific channel or all channels at once
- SMS Help Page — for assistance and troubleshooting
SMS opt-out is channel-specific. Opting out of one channel (for example, SuperSpeak) does not opt you out of others (for example, LVC All-Hands). To opt out of all LVC SMS channels at once, use the opt-out page or contact the IT administrator below.
For questions about the information we hold about you, to correct any inaccurate information, to request a copy of your engagement data, or to request deletion (subject to the retention requirements in Section 5), contact Tony Bohn (see Section 10).
Closing your app account
You can ask us to close your LakeviewApp / dashboard account at any time using our account request form, by emailing tony@lvconstruction.com, or by calling 262.857.3336. Within 30 days we turn off your access to the app and dashboard, remove your phone from our notification list, and stop sending you app emails and texts.
What we keep. The Services are work tools, and the information tied to your account is Lakeview Construction business information. We keep it after your account is closed, including: your name and the email address and phone number you gave us, the daily reports, photos, videos, messages and other project records you submitted, sign-in and activity history, and the record of your request. We keep these records to run and document our construction projects, for warranty, safety and legal purposes, and as required by the retention terms in Section 5. Closing your account turns off your access only. Lakeview Construction does not delete this data; we keep it indefinitely, and if you ask us to delete your data we will close your account but still keep these records as described here and in Section 5. Uninstalling the app removes everything the app stored on your phone.
7Security
Personal information is stored in Microsoft Azure under our enterprise tenant, encrypted at rest (Azure Storage Service Encryption with Microsoft-managed keys) and in transit (TLS 1.2 or higher). Authentication to the dashboard and mobile app requires Microsoft 365 sign-in (Lakeview employees) or the Lakeview Partners sign-in (subcontractor superintendents). All app traffic uses encrypted HTTPS connections. The Distro recipient experience uses a path-scoped HMAC-signed session cookie that cannot access any other dashboard surface. Access to engagement reporting is limited by role. We monitor for unusual activity using Azure's built-in security tooling and a Sophos firewall layer at our office network.
8CTIA and TCPA compliance
Our SMS messaging program is designed to comply with:
- Cellular Telecommunications Industry Association (CTIA) Short Code Monitoring Handbook — including the requirements for clear sender identification, message-type disclosure, frequency disclosure, message-and-data-rates disclosure, STOP and HELP keyword handling, and separate-and-standalone consent.
- Telephone Consumer Protection Act (TCPA) — including the requirements for prior express consent for non-emergency informational text messages and immediate honoring of opt-out requests.
- Microsoft Azure Communication Services Acceptable Use Policy and Toll-Free Verification requirements — including the requirement that consent for SMS messaging not be bundled into any other agreement.
SMS consent is collected exclusively on our standalone SMS Opt-In page. Consent is voluntary and is not a condition of employment, contractor engagement, hiring, continued work, or use of any other Lakeview Construction service.
9Children
The Services are intended for use by Lakeview Construction employees, contractor superintendents, sub-superintendents, and office staff only, all of whom are at least 18 years of age. We do not knowingly collect information from minors. The SMS opt-in form requires affirmation that the person opting in is at least 18 years of age.
10Changes to this policy
We may update this Privacy Policy from time to time. The "Effective date" and "Last updated" lines at the top of this page reflect the most recent revision. Material changes will be communicated via a notification in the LVC IT Dashboard or, for active SMS subscribers, via an LVC Distro message.
